3. Purpose

The processing of personal data is necessary for the purpose of providing the Services to Active TeleCare Solutions Limited’s service users of in accordance with the terms of the Relevant Contracts between the Parties.

The term of this agreement shall be the same as the term of the Relevant Contracts (including any extension periods) and this agreement shall terminate upon the termination of the Relevant Contracts provided that any provision in this agreement which expressly or by implication is intended to come into force or continue in force on or after termination of this agreement shall remain in full force and effect.

For the avoidance of doubt, this agreement shall continue until the last surviving Relevant Contract between the Parties expires or is terminated.


4. Processing

Processing means any operation or set of operations which is performed on Personal Data or on sets of Personal Data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.


5. Personal Data Breach

Personal Data Breach means a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, Personal Data transmitted, stored, or otherwise processed.


6. Services

Services means telecare and monitoring provided by Active TeleCare Solutions Limited under the terms of any current or Relevant Contracts (Agreement for the provision of telecare and monitoring services). The processing of personal data is necessary for the purpose of providing these Services.


7. Personal Data We Process

The Personal Data provided will relate to the following categories of data subjects:

  • Service users
  • Services users’ emergency contacts or next of kin
  • Service users’ Doctor

The Personal Data to be processed may include:

  • Names
  • Gender
  • Phone number(s)
  • Email address
  • Date of Birth
  • Age
  • Address
  • Location data
  • Next of Kin / Emergency contact(s) (name, phone number(s))
  • Doctor’s name and contact details


8. Use, Disclosure and Publication

Active TeleCare Solutions Limited take the security of your personal information seriously and use reasonable administrative, technical, and physical measures to protect your personal data from unauthorised access, use, or disclosure.

We will process Personal Data purely for the Purpose and will not retain or process the Personal Data for any other purposes.

We warrant that the Personal Data shall not at any time be copied, broadcast, or disseminated to any other third parties, except in accordance with this agreement.

The Personal Data will only be retained in order to carry out the Purpose and will be retained for a period of two years after the expiry or termination of the Relevant Contracts unless:

a) the service user, by written instructions indicates otherwise; or,
b) required by law to keep for a specified period.


9. Confidentiality

Active TeleCare Solutions Limited shall not use or divulge or communicate to any person (without the prior written authority of the service user) any Personal Data obtained, which it shall treat as private and confidential and safeguard accordingly.

Active TeleCare Solutions Limited may disclose Personal Data to the extent permitted by law, by any governmental or other regulatory authority, or by a court or other authority of competent jurisdiction provided that, as far as it is legally permitted to do so, it gives the service user as much notice of the disclosure as possible.

Active TeleCare Solutions Limited shall be responsible for:

a) ensuring the reliability of any employees, workers, or agents or those of any sub-contractor who have access to any Personal Data; and,

b) ensuring that those persons receive training in the GDPR, confidentiality, security, and the care of Personal Data.


10. Security
of your personal information

Active TeleCare Solutions Limited is registered with the Information Commissioner’s Office as a Data Controller and Processor, ensuring the highest levels of data protection for those who rely on us for assistance.

Active TeleCare Solutions Limited warrants that it will:

a) having regard to the state of technological development and the cost of implementing any measures, take appropriate technical and organisational measures against the unauthorised or unlawful processing of Personal Data and against the accidental loss or destruction of, or damage to, Personal Data to ensure a level of security appropriate to:

  • the nature of the data to be protected.

c) discharge its obligations under this agreement with all due skill, care, and diligence.

All inbound and outbound calls to our alarm receiving centre are recorded and performance levels are constantly monitored to ensure we always deliver the highest levels of customer care.


11. Legal basis for processing Personal Data

We process your personal data on the following bases:

Contractual Necessity: To perform our contract with you or to take steps at your request before entering into a contract.

Legitimate Interests: To pursue our legitimate interests, such as improving our products and services, marketing, and fraud prevention.

Consent: When you have given us explicit consent to process your information for a specific purpose.


12. Your Data Protection Rights

Depending on your location, you may have the following rights regarding your personal data:

Right to Access: You have the right to request copies of your personal data.

Right to Rectification: You have the right to request that we correct any information you believe is inaccurate or complete information you believe is incomplete.
